(v) register to and/or attend our events;

(vi) submit a curriculum vitae or application to a job vacancy;

(vii) attend an interview or assessment;

(viii) ‘follow’,  ‘like’,   post to  or  interact  with   our  social  media accounts, including Instagram, Twitter, Facebook and TokTok;

(ix) interact in any other way with us as Talent or potential Talent; 

(x) interact in any other way with us as a Client or potential Client;

(xi) engage in correspondence between us (we may keep a record of that correspondence)

(xii) engage in transactions with us; and/or 

(xiii) use our website, subject to clause 14 herein below.

 

14.Use of this Website and our social media: The Animal Talent Ltd does not require you to provide Personal Data in order to browse this Website or its social media. When entering our Website or any social media platform of The Animal Talent Ltd, registration is not required. Therefore if you are merely a visitor of our media platforms, we do not collect any Personal Data about you, except to a very limited extent through our cookies as described in our Cookies Policy.

 

15.Third party websites: This Website and our communication tools may contain links to third party websites including our partners, advertisers, suppliers and clients or resources of possible interest to you, including third-parties social media platforms (“Third Party Sites”). 16.We may collect, use, store and transfer different kinds of Personal Data which you have provided to us and/or which we have collected from you. This will include (depending on the circumstances):

(i) identity and contact data: title, names, addresses, email addresses, phone numbers and gender;

(ii) talent application data: if you are submitting a Talent Application Form, you will also be asked to provide your pet’s information and you will also be asked to supply a link to your Instagram account and photographs of your pet/s;

(iii) portfolio profile data: if you are a Talent or potential Talent we represent we will also collect your pet’s information and you will also be asked to supply a link to your Instagram account and photographs of your pet/s; 

(iv) financial data: if you are booking Talent or otherwise purchasing our services, you will also provide payment details, which may include billing addresses, credit/debit card details and bank account details. You will also be asked to supply payment details if you are Talent which we represent; 

(v) employment and background data: if you are submitting a job application, you may also provide additional information about your academic and work history, qualifications, skills, projects and research that you are involved in, references, proof of your entitlement to work in the UK, your national security number, your passport or other identity document details, your current level of remuneration (including benefits), and any other such similar information that you may provide to us;

(vi) survey data: from time to time we might ask if you would be willing to participate in our surveys; if you agree, we will also collect any information that you provide as part of that survey;

(vii) Information contained in correspondence: we will collect any information contained in any correspondence between us. For example, if you contact us by email or telephone, we may keep a record of that correspondence;

(viii) transactional data: we will collect information related to your transactions with us, including the date and time, the amounts charged and other related transaction details; and

(ix) website usage and technical data: we will also collect certain information about how you use our website and the device that you use to access our website. This might include your geographical location, device information (such as your hardware model, mobile network information, unique device identifiers), the data transmitted by your browser (such as your IP address, date and type of the request, content of the request regarding the specific site, time zone settings, access status/HTTP status code, volume of data transmitted, browser type and version, language settings, time zone settings referral source, length of visit to the website, date and time of the request, operating system and interface) and number of page views on the website and similar information. 17.The Animal Talent Ltd does not intentionally collect any special categories of Personal Data, including information revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade-union membership, genetic or biometric data, information concerning a natural person’s sex life or sexual orientation (“Sensitive Personal Information”), unless:

(i) it is legally required to do so, for example, for recruitment purposes; or

(ii) talent we represent elects to provide dietary requirements, health conditions and whether or not you have a disability for the purposes of effecting job bookings.

 

If you fail to provide Personal Data

18.Where we need to collect your Personal Data by law, or under the terms of a contract we have with you and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with goods or services). In this case, we may have to cancel a product or service you have with us but we will notify you if this is the case at the time.

 

How safe is it? Who sees it?

19.All the information you give us is held on The Animal Talent Ltd’s database, which is secure, password protected and which is accessed only by trained staff and working from The Animal Talent Ltd’s own computers.

 

20.Some data will be exported in a spreadsheet format and stored on a personal computer or hard drive for a limited purpose and limited time.  All electronic devices used to store data are password protected and encrypted (meaning they can’t be hacked) and data is only available to individuals on a need-to-access basis.

21.We collect Personal Data to carry out and support our talent management business, including but not limited to evaluating the applications to become a talent or an employee of The Animal Talent Ltd, to place bookings with clients, to communicate by electronic mail or post, to authenticate an order, to request information, to subscribe to our Newsletter or the like.

 

22.We process the Personal Data collected for the above recited purposes as follows:

(i) when the Personal Data owner has given his/her/its consent for one or more specific purposes. You can give or withdraw your consent at any time and where we believe data has been retained without your consent we will endeavour to take all necessary steps to remove or restrict the use of that data and/or obtain your consent (where we think it was your intention to give it)

(ii) when processing of Personal Data is necessary for the performance of a contract and/or for any pre-contractual negotiation or obligations;

(iii) when processing is necessary for the purposes of the legitimate interests pursued by the Personal Data owner or by The Animal Talent Ltd, such as promoting the Personal Data owner’s professional activity and/or The Animal Talent Ltd’s business activities; and

(iv) when processing Personal Data is necessary for compliance with a legal obligation.

23.We will only use your personal data when the law allows us to. Most commonly, we will use your personal data in the following circumstances:

(i) Performance of contract: this means processing your data where it is necessary for the performance of a contract to which you are a party or to take steps at your request before entering into such a contract;

(ii) Legitimate Interest; this means the interest of our business in conducting and managing our business to enable us to give you the best service/product and the most secure experience. We make sure we consider and balance any potential impact on you (both positive and negative) and your rights before we process your personal data for our legitimate interests. We do not use your personal data for activities where our interests are overridden by the impact on you (unless we have your consent or are otherwise required or permitted to by law). Our legitimate interests don’t automatically override yours and we won’t use your information if we believe your interests should override ours unless we have other grounds to do so (such as your consent or a legal obligation). Purposes for which we will use your Personal Information

(i) To provide access to our website: to provide you with access to our website in a manner convenient and optimal and with personalised content relevant to you including sharing your information with our website hosts and developers (on the basis of our legitimate interest to ensure our website is presented in an effective and optimal manner);

(ii) To publish your portfolio on the website: when agree to be represented by us, we will use the details proved in your Talent Application Form and other personal information provided to us such as your portfolio images to prepare a portfolio profile page (on the basis of performing our contract with you and on our legitimate interest to promote our website and services as a talent agency); 

(iii) To make and facilitate bookings: we will use your information to facilitate bookings of Talent we represent (on the basis of performing our contract with you if you are Talent we represent or on the basis of our legitimate interests to supply our services as a talent agents if you are a Client seeking to book a Talent); 

(iv) To process and facilitate transactions with us: we will use your information to process transactions and payments and to collect and recover money owed to us (on the basis of performing our contract with you and on the basis of our legitimate interest to recover debts due); 

(v) To share information about our Talent with other Talent agencies: where you give us your permission to do so, we will share your personal information with other talent agencies for the purpose of actual or prospective bookings; 

(vi) Relationship management: to manage our relationship with you, which will include notifying you about changes to our terms of use or privacy notice, and asking you to leave a review or take a survey (on the basis of performing our contract with you, to comply with our legal obligations and on the basis of our legitimate interests to keep our records updated and study how our website and services are used); 

(vii) User and customer support: to provide customer service and support (on the basis of our contract with you or on the basis of our legitimate interests to provide you with customer service), deal with enquiries or complaints about the website and share your information with our website developer, IT support provider, software and hosting providers, payment services provider, marketing provider and professional advisers as necessary to provide customer support (on the basis of our legitimate interest in providing the correct services to our website users and to comply with our legal obligations); 

(viii) Prize draws, competitions and surveys: to enable you to take part in prize draws, competitions and surveys (on the basis of performing our contract with you and our legitimate interest in studying how our website and services are used, to develop them and grow our business); 

(ix) Recruitment: to process any job applications you submit to us, whether directly or via an agent or recruiter including sharing this with our third party recruitment agency (on the basis of our legitimate interest to recruit new employees or contractors) and we will process any Sensitive Personal Information you supply to us to ensure we meet our legal obligations to facilitate access and equal opportunities to job applicants; 

(x) Health and safety: to process Sensitive Personal Information so that we can protection your health and safety when arranging a booking for you (on the basis of either your explicit consent for us to collect and use this information or in circumstances where the processing is necessary to protect your vial interests at a time where you are not capable of giving your consent, such as to inform medical professionals in a medical emergency); 

(xi) Marketing: to keep in contact with you about our news, events and services that we believe may interest you, provided that we have the requisite permission to do so and sharing your information with our marketing services provider (Mailchimp) (either on the basis of your consent where we have requested it, or our legitimate interests to provide you with marketing communications where we may lawfully do so); 

(xii) Advertising: to deliver relevant website content and advertisements to you and measure or understand the effectiveness of the advertising we serve to you (on the basis of our legitimate interests in studying how our website/services are used, to develop them, to grow our business and to inform our marketing strategy); 

(xiii) Social media interactions: to interact with users on social media platforms including Instagram, Twitter, Facebook and TikTok. For example, responding to comments and messages, posting, ‘retweeting’ and ‘liking’ posts (on the basis of our legitimate interest in promoting our brand and communicating with interested individuals);

28.In managing, advising, counselling, promoting and negotiating the activities of its Talents, The Animal Talent Ltd is requested to share Personal Data with clients or prospective clients in all areas of the entertainment industry for the purpose of their job confirmations and enquiries. Please note some of our Clients may be based outside of the European Economic Area.

 

29.With the aim of promoting Talents’ images and career, The Animal Talent Ltd also shares on its website and with clients their images or videos and/or portfolios containing Personal Data such as name and contact details plus animal descriptors.

 

30.The Animal Talent Ltd does not disclose or share Personal Data with any external entity or third party, except as strictly necessary in connection with its business activities for example  to:

(i) clients to illustrate experience and/or capabilities of animal models and talents and/or handlers;

(ii) external authorized certified public accountants for tax purposes;

(iii) external authorised lawyers for legal purposes;

(iv) debt collections and credit references agencies; and/or

(v) travel agencies, restaurants, hotels and airlines to arrange business travels.

 

31.We may also disclose or share any Personal Data with external service providers to assist with, for example:

(i) website development and hosting services plus  IT, system administration and security services;

(ii) marketing and advertising services (including the Google AdWords service), analytics providers (including Google Analytics) and advertiser and other administrative support services to collect, manage, analyse, and otherwise process Personal Data and business information;

(iii) social media plugin services including Facebook, Twitter, TikTok and Instagram;

(iv) payment services;

(v) identity verification, fraud prevention and detection services;

(vi) banking services;

(vii) legal, accountancy, auditing and insurance services and other professional advisers;

(ix) regarding any prospective sale of our business or assets or purchase of either businesses, only in the event that we decide to sell or buy any business or assets.

 

32.The Animal Talent Ltd may also be required to disclose Personal Data to third parties as a matter of law – for example to HM Revenue & Customs, advisors, regulators, governmental bodies and other authorities acting as processors or joint controllers – who require reporting of processing activities in certain circumstances to protect its legal rights and/or in an emergency where the health or security of a person is endangered and/or in accordance with the local relevant legislations.
